General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)the hazard of being struck by/run over by utility trailer. The employer did not adequately train employees in the recognition and avoidance of unsafe conditions and require that employees ride in the truck cab and not ride on the attached trailer or truck rear bumper and tailgate, prior to and on February 21, 2002. Among other methods, one feasible and acceptable abatement would be to establish a well defined company policy with disciplinary procedures that required employees to ride in the truck cab and not ride on equipment that was not designed or intended for that purpose.
