General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck or caught in between the lift and the ground in the event employees fall or get thrown off. The employees operating the Model 6034 and 5030 Sky Trak forklifts were exposed to being caught in between/crushed from not using the installed seat belts. Note: Among other methods, one feasible and acceptable abatement to correct this hazard is to train/certify and observe employees wearing seat belts installed by the manufacturer.
