North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)falls from elevation. Employees of Sofia Enterprises utilized a forklift on the South Wing of the Chatham Woods project, Elkin, NC, equipped with a trash box, to reach heights approximately 42 feet in the air, prior to and on May 29, 2002. The forklift is not designed by the manufacturer to be used for lifting employees. Reference:Operator Manual for the JCB 506C Loadall. Section 1 - Operating Safety: WARNING: Passengers: Passengers in or on the machine can cause accidents. The JCB Loadall is a one man machine. Do not carry passengers. (INT-2-2-2)
