North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)the 2800 lb, Yale forklift, s/n N307675, which was not equipped with seat belts, at the operator's station, exposing the operator to being struck/caught by the vehicle's frame in the event of an accident. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to install seat belts on the forklift and require the operator to wear them while operating the forklift. (Reference: ASME/ANSI B56.1a-1989, Addenda to ASME/ANSI B56.1-1988, and ASME B56.1-1993 - Safety Standard for Low Lift and High Lift Trucks)
