North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck by or caught between the vehicle lift and the concrete floor in the event the hydraulic lift failed. The employees operating the #1 vehicle lift, brand name unidentified, Model# EC183TC-4AE120-800, in the garage bay area, were exposed to being caught between/crushed from, the safety pin not in place on the lift while in the up position, hydraulic control lever not returning to the neutral/safe position, lack of operator training/qualification, lack of preventative maintenance/periodic qualified inspections, lack of certifications, and lack of documentation on June 20, 2002. b)being struck by or caught between the vehicle lift and the concrete floor in the event the hydraulic lift failed. The employees operating the #2 vehicle lift, brand name unidentified, Model# unidentified, in the garage bay were exposed to being caught between/crushed from, the safety pin not in place on the lift while in the up position, lack of operator training/qualification, lack of maintenance/periodic qualified inspections, lack of certifications, and lack of documentation on June 20, 2002. c)being struck by or caught between the vehicle lift and the concrete floor in the event the hydraulic lift failed. The employees operating the #3 vehicle lift, Pro- Lift, Model BP 12FW Lift (12,000 lbs), S/N-3869 (11/3/93), in the garage bay were exposed to being caught between/crushed from, the safety switch being by- passed with a clamp, lack of operator training/qualification, lack of maintenance/periodic qualified inspections, lack of certifications, and lack of documentation on June 20, 2002. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train/certify employees on preventative maintenance, periodic inspections and corrective action for safety pins, hydraulic control levers and safety switches.
