North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being struck by or caught between the forklift in the event of an upset. The Hyster forklift model number S20A, serial number unknown, 3,000 lb. capacity had no seatbelt installed for operator use while being operated. Among other methods, one feasible and acceptable abatement method to correct this hazard was to install a seat belt and require the operator to wear it while operating the forklift. (Reference: ASME/ANSI B56.1a-1989, Addenda to ASME/ANSI B56.1-1988, and ASME B56.1-1993 - Safety Standard for Low Lift and High Lift Trucks)
