Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a slipping/tripping/falling hazard: (a)Loading Area - On or about July 15, 2002, employees had no fall protection while working on the trailer of a flatbed truck to load steel. The employees were 55.5 inches above the shop floor when standing directly on top of the trailer and 72.5 inches above the shop floor when standing on top of the steel stacked on the trailer. Among other methods, one feasible and acceptable abatement method to correct this hazard is to institute a fall protection program and to provide fall protection equipment to employees.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling loads and/or falling hoist/crane parts: (a)Loading and Layout Areas - On or about July 10, 2002, employees used a P&H Hevi-Lift cab operated 5 ton underhung crane with a 5 ton hoist to move a beam 63 feet long, with a web width of 36 inches and a weight of 160 pounds/foot. This beam exceeded the rated load of the crane. (b)Layout Area - On or about July 10, 2002, when attaching a beam 63 feet long, with a web width of 36 inches and a weight of 160 pounds/foot to the P&H Hevi-Lift cab operated 5 ton underhung crane, employees did not take care to make certain that the sling, attachments, lifting devices, etc. were clear of all obstacles in that a lift clamp hanging on the chain sling, caught the flange of the beam, causing the beam to topple over and fatally crush an employee. (c)Fabco, 211 Beale Avenue Rear, Altoona, PA - On or about July 11, 2002, the employer did not perform sufficient frequent and periodic inspections and document the periodic inspections on the P&H Hevi-Lift cab operated 5 ton underhung crane. Monthly (frequent) inspections did not include items such as controllers, master switches, contacts, crane runways, track sections, etc., and comprehensive periodic inspections did not occur. Among other methods, one feasible and acceptable abatement method to correct these hazards includes, developing a frequent and periodic inspection and preventative maintenance program which incorporates all the recommendations outlined in the manufacturer's manuals with written and signed reports, and which follows the American National Standard Institute safety standard for Monorail Systems and Underhung Cranes (ANSI B30.11-1998) and to follow operating requirements also specified in that ANSI standard.y
