Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to standing and working from the midrail of a scissor lift. Among other methods to correct this hazard is to have the employee stand on the platform of the scissor lift to do his work: (a) Jobsite: On or about 4/25/03 an employee was working from a scissor lift and was standing on the midrail. The employee was not tied off.
