Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by the front end loader: (a) Meadowview Nursing facility: On or about 03/03/03 the Massey Ferguson, Model 350, front end loader was being operated without a seat belt; it was not equipped with an audible horn and/or back up alarm; the front and rear windshield wipers were broken; the electrical wiring system was in poor condition; and the hydraulic lift cylinder was leaking. Among other methods, one feasible and acceptable means to abate this hazard is correct all of the unsafe conditions and develop a preventative maintenance program in accordance with the manufacturer's specifications.
