Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees was exposed to a 10 fall: (a) On or about August 25, 2003 at or about 195 Island parkway Ave. Defiance, Ohio in the driveway of Good Samaritan SchooL, employees were using the bucket of a Case 580 backhoe, front end loader for the purpose of elevating overhead communication wires where one of the employees was standing in the front bucket which was elevated to reach the overhead cables when he contacted energized electrical lines with a current of approximately 7,200 volts. Abatement Note: Among others, one feasible means of abatement would be to follow the Case owner/operator manual which states "do not allow other persons to ride on the machine. Other persons can fall or can cause an accident. This is a one person machine with one operator's seat." Or the Equipment Operators Institute's Safety manual for backhoe/loader which states "Never use a bucket for a work platform or personnel carrier." No additional abatement information is needed for this item.
