Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that, employee(s)
were exposed to the hazard of amputations:
(a)  Press area:  On January 17, 2003 and on February 11, 2003, the
Cincinnati 230 Ton
hydraulic press brake and the Skylight Mechanical Press Brake used to bend
metal parts
was not provided with safeguarding to protect operators who placed their
hands
approximately 3-inches from the point of operation.
Among others, one feasible and acceptable abatement method to correct this
hazard is to
provide point of operation safeguarding in accordance with Section 6.1.4
(1) of American
National Standards Institute, ANSI B11.3-1982, Safety Requirements for
Construction,
Care and Use of Power Press Brakes.
(b)  Press area:  On January 17, 2003 and on February 11, 2003, the
Cincinnati 230 Ton
hydraulic press brake was used in a two-person operation mode while each
operator was
bending separate parts and the press brake did not provide for concurrent
operation of
each operator to cycle the machine.  The Cincinnati 230 Ton hydraulic
press brake was
operated by a single mechanical foot pedal for cycling the machines.
Among others, one feasible and acceptable abatement method to correct this
hazard is to
provide a foot switch for each operator that would require concurrent
operation for the
press brake to cycle in accordance with Section 4.4 of the American
National Standards
Institute, ANSI B11.3-1982, Safety Requirements for Construction, Care and
Use of
Power Press Brakes.

29 CFR 1910.212(a)(3)(ii):  Point(s) of operation of machinery were not
guarded to prevent
employee(s) from having any part of their body in the danger zone(s)
during operating cycle(s):
(a)  Press area:  On January 17, 2003 and on February 11, 2003, the

hydraulic press brake and the Skylight Mechanical Press Brake used to bend
metal parts
was not provided with safeguarding to protect operators who placed their
hands
approximately 3-inches from the point of operation.
