ORS654.010: The employer did not furnish a place of employment which was safe and healthful for employees, and did not do every other thing reasonably necessary to protect the life, safety, and health of the employees: (a) The driven shaft, of the Brush Hog attachment, to the John Deere model 5700 diesel powered, rubber tired tractor, available for use in the vehicle storage shed at the Umatilla County Fair Grounds, had a damaged non-rotating guard which exposed a minimum of 5 1/2" of unguarded shaft to contact.d
