Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was riding on a hydraulic lift gate of a moving truck. North Avenue jobsite - Employee was riding on the hydraulic lift gate/tailgate of a moving truck. Among feasible means of abatement would be to ride in the cab of the truck or to provide a secured platform with guardrails on the back of the truck for employees to ride in.
