Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was sitting on the top rail, with his feet hanging to the outside of the scissor lift. Barnes and Noble jobsite - Employee using scissor lift approximately 24 feet above grade was exposed to fall hazards. Employee was sitting on top rail with his feet hanging to the outside of the guardrails while plastering. Among feasible means of abatement would be to comply with American National Standards Institute, ANSI A92.6-1999 Standard for Self Propelled Elevating Work Platforms. NO CERTIFICATION REQUIRED FOR THIS ITEM
