Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment which was free from recognized hazards that were
likely to cause death
or serious physical harm to employees in that employees using descent
control equipment (Sky
Genie) during window cleaning operations were exposed to fall hazards.
a)Highland Oaks Jobsite - The lifeline used by the employee on the descent
control
equipment was attached to the scaffold outrigger and the same steam pipe
as the
working line. The lifeline was not independent from the descent control
equipment rigging.
b)Highland Oaks jobsite - The rigging equipment used to suspend the descent
control equipment was anchored with counterweights only. A tieback was not
used as a secondary means of anchorage.
c)Highland Oaks jobsite - The rigging equipment was moved horizontally
while an
employee was suspended on the descent control equipment.
d)Highland Oaks jobsite - A screwdriver was used in lieu of a through bolt
on the
rigging equipment. The rigging equipment was not maintained in a safe
condition.
Among feasible means of abatement would be to comply with the American
Society of
Mechanical Engineers (ASME) Safety Requirements for Window Cleaning, ASME
A39.1-1991; American National Standards Institute (ANSI) Safety
Requirements for
Scaffolding, ANSI A10.8-1988; the Code of Federal Regulations 29 Part
1910; and the
Code of Federal Regulations 29 Part 1926; regarding the safety principles
applicable to
similar equipment such as boatswain's chairs and single point suspended
scaffolding.
One Source Building Services,Inc. has been previously cited for violations
of similar
Occupational Safety and Health standards which were contained in OSHA
inspection
#107693640 issued on September 12, 2000 with regards to a jobsite in
Syracuse, NY.
