Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment which was free from recognized hazards that were
likely to cause death
or serious physical harm to employees in that an effective motor vehicle
maintenance program
was not maintained and that motor vehicles were not kept in a safe and
proper operating
condition at all times.
a)Ford LP Gas Delivery Truck #35 - Oil leak in the rear main seal was not
repaired
and/or evaluated as soon as reported by the driver.
b)The daily driver inspection reports of motor vehicles were not certified
with
the
driver's signature, nor did the inspection reports indicate that all noted
defects
and deficiencies had been repaired and again reviewed and certified by the
original driver.
Among feasible means of abatement would be to comply with the National Fire
Protection Association, NFPA 58 Standard for the Storage and Handling of
Liquefied
Petroleum Gases;  and the Department of Transportation Federal Motor
Carrier Safety
Regulations Part 396.
