Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment free from recognized hazards
that are causing
or likely to cause death or serious physical harm to employees in that
employees were potentially
exposed to M. Tuberculosis from an infected elephant.
Employees in proximity to a M. tuberculosis infected elephant (Lota) were
potentially exposed
to respirable M. Tuberculosis without the protection of an effective
medical monitoring program.
Among other methods, one feasible and acceptable abatement method to
correct the hazard
include:
1.  All employees that are in contact with elephants should receive annual
screening
examinations for tuberculosis with appropriate follow-up and treatment
following established
medical guidelines.  New employees should be screened prior to contact
with elephants.
2.  Provide training and information to employees to ensure employee
knowledge of the hazard
of TB transmission, TB's signs and symptoms, purpose of medical
surveillance and follow-up
therapy, and site specific hazard control procedures.
3.  Notification of all employees when an elephant cultures positive for
M. Tuberculosis.
4.  Administratively limit access to an infected elephant to essential
elephant care employees.
