Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that, employees were exposed to crushing injuries: a) On or about March 5, 2002 employees observed operating forklift trucks without wearing seatbelts. The employees were exposed to crushing injuries in the event of a forklift tip-over or similar accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that inoperable seat belts are repaired or replaced and that their use is enforced prior to the forklifts returning to service. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
