Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to potential injuries and/or illnesses during permit required confined space entries: 1) On or about July 8, 2002, employees entered a confined space tank to perform painting operations. The paint contained chemicals that are flammable, that have an OSHA PEL, and that are capable of causing death, incapacitation, impairment of ability to self rescue, and/or injury or acute illness. No air monitoring was conducted prior to and during the entry, and the employer did not develop a rescue plan. Among other methods, one feasible and acceptable method to correct this hazard is to develop a permit required confined space entry program that meets the requirements of ANSI Z117.1-1989. OR IN THE ALTERNATIVE: 29 CFR 1926.21(b)(6)(i): Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required: 1) On or about July 8, 2002, employees entering into a confined space tank to perform painting operations were not instructed in the use of air monitoring equipment, and non entry rescue equipment. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification
