North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite, employee standing on step of Case 580 Super Backhoe was riding as a passenger. Reference: 580 Super E Loader Backhoe, Operator's Manual, Burl 9-8893 dated 1995. CAUTION box on the top of page 10 states: Do not permit riders on machine. This is a one man machine.
