Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to being crushed by free-standing steel pilings.
a)At the construction site, Museum of Jewish Heritage, 18 First Place, New
York
NY
On or about April 9, 2002
Three employees were exposed to the uncontrolled toppling of free standing
sections of 13 feet long x 14" diameter round steel pilings, partially
filled with
concrete, that were cut at the required elevation.
Among other methods, feasible and acceptable methods to correct this
hazard is to:
a) Secure the piling, using a sling and crane/excavator and immediately
knock down and remove
each piling after it is cut.
NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN
THE INSPECTION CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION
OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY
REQUIRED BY 29 CFR 1903.19.

An employee used a Husqvarna model 372 chain saw to cut timber/wood without
wearing any cut resistant clothing.

FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY
OF $1,000.00 AS PER 29 CFR 1903.19.
