Section 5(a)(1) of the Occupational safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to impact injuries from falling speakers due to the employer's failure to ensure adequate mechanical tip stability as recommended by American National Standard Institute/Electronic Industries Association (ANSI/EIA-636-1996) Standard for Recommended Loudspeaker Safety Practices. a. On or about July 24, 2002, at the Tweeter Center located at 19100 South Ridgeland Avenue, Tinley Park, IL, employee(s) were exposed to the hazard(s) of being struck by loudspeaker(s). An employee of NEJA Group LLC dba Tweeter Center was fatally injured when he was struck by two falling loudspeakers. The employer failed to ensure that the loudspeakers were provided with adequate mechanical tip stability as recommended by ANSI/EIA-636-1996.
