Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm in
that; employees seated
on a "Kennco Transplanter", were exposed to the hazard of being struck by
vehicles
traveling over the road, while being transported from field to field over
the road.
a) At the tomato field located on County Road 578 also known as St. Joe
Road, Dade
City Fl. Employees were exposed to the hazard of being struck by
commercial and
/or privately owned vehicles traveling over the road. Employees were
transported
between fields seated on a "Kennco Transplanter", this equipment, pulled
by a tractor
is designed to assist workers in planting tomatoes. The Kennco
transplanter was not
designed to transport passengers over public roadways. on or about 3/6/02
ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO :
1)  Follow the Florida Criminal and Vehicle Handbook, Section 316.2015.
Unlawful
for persons to ride on the exterior of vehicle; Paragraph 20 states, " No
person shall
ride on any vehicle upon any portion thereof not designed or intended for
the use of
passengers", and comply with the manufacturer's prohibition against
transporting
employees sitting in the seat of the Kennco Transplanter to or from the
field.
