Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by, and crushed by, a citrus loader, which had an obstructed view to the front or rear, when the citrus loader was operated in the reverse direction or when turning into a row. On 5/3/02 the employer's Peterson Lightning Loader (citrus loader), Model #CL3, Serial #CL3-0497-557, was involved in a fatal accident at an orange grove located on Owens Road, Wimauma, Florida. The citrus loader ran over an employee while it was turning into a row of trees. Vehicle safety/warning devices, the horn and backup alarm, were not operational, and the operator of the citrus loader did not adequately check and make certain that the area directly in front of the citrus loader was clear before turning the equipment into that row. One feasible and acceptable abatement method to correct this hazard would be to operate and maintain the citrus loader in accordance with the "IMPORTANT WARNINGS AND INSTRUCTIONS FOR THE OPERATION OF ALL PETERSON CITRUS LOADING EQUIPMENT" which are contained in the owners manual that was provided to the employer at the time that the citrus loader was purchased. 1)On page #4, paragraph #7, of the owners manual, the warnings and instructions state: DO NOT ATTEMPT TO OPERATE THIS LOADER OR DUMP BODY IF ANOTHER PERSON IS WITHIN TWENTY (20) FEET OF SAID EQUIPMENT. 2) On page #5, Paragraph # 18, of the owner's manual, the warning and instructions state: OPERATOR SHOULD ALWAYS BE CERTAIN BACKUP ALARM IS IN PROPER WORKING ORDER BEFORE BACKING UP THE EQUIPMENT. "DOCUMENTED ABATEMENT VERIFICATION IS REQUIRED FOR THIS ITEM"
