Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm in
that an employee was
exposed to the hazard of falling or being thrown from a Boom-Supported
Elevating Work
Platform as the employee was not wearing a personal fall arrest system:
(a) West Side, 1395 6th Street N.W., Winter Haven - An employee was
installing
backing material for stucco 10 to 20 feet above the ground from the bucket
of a
Genie, Model Z-60/34, Boom-Supported Elevating Work Platform and did not
have a
personal fall arrest system; exposing the employee to the hazard of
falling or being
thrown from the bucket of the lift.
Among others, one feasible and useful abatement method to correct this
hazard is to:
(1) Follow the requirements of American National Standards
Institute/Scaffold
Industry Association, ANSI/SIA A92.5-1992, Boom-Supported Elevating Work
Platforms; Section 8, Paragraph 8.8(g), "Ensure all personnel in the
platform are
wearing fall protection devices and other safety gear as required at all
times."d
