Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm in
that employees were
exposed to the hazard of falling or being thrown from a Boom-Supported
Elevating Work
Platform as the employees were not using a personal fall protection device:
(a) South Side, 6800 State Rd. 33, Lakeland -
(1) Two employees were caulking (Masonry Material) the joints between the
slabs of
a pre-cast concrete lift-slab wall 10 to 28 feet above the ground from the
bucket of a
JLG, Model 400S, Hi-Lift Rentals #57109, Boom-Supported Elevating Work
Platform
and one of the employees did not have a personal fall protection device;
exposing the
employee to the hazard of falling or being thrown from the bucket of the
lift.
(2) Two employees were caulking (Masonry Material) the joints between the
slabs of
a pre-cast concrete lift-slab wall 10 to 28 feet above the ground from the
bucket of a
JLG, Model 400S, United Rentals #293933, Boom-Supported Elevating Work
Platform and one of the employees did not have the lanyard of his personal
fall
protection device attached to the lanyard attachment point; exposing the
employee to
the hazard of falling or being thrown from the bucket of the lift.
Among others, one feasible and useful abatement method to correct this
hazard is to:
(1) Follow the requirements of American National Standards
Institute/Scaffold
Industry Association, ANSI/SIA A92.5-1992, Boom-Supported Elevating Work
Platforms; Section 8, Paragraph 8.8(g), "Ensure all personnel in the
platform are
wearing fall protection devices and other safety gear as required at all
times."d
