Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer failed to provide a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees: a. On or about April 18, 2002, at the jobsite located at Kingfisher Lane and Owl Drive in Rolling Meadows, Illinois, employees were permitted to enter the swing pivot area of the backhoe and exposed to being struck by the bucket of the backhoe. Among feasible means of abatement would be to comply with the Equipment Manufacturers Institute Safety Manuel for Backhoe/Loader Machines and to prohibit employees from entering the swing pivot area. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
