Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety
Act):  Every
employer shall furnish to each of his employees employment and a place of
employment which
are free from recognized hazards that are causing or are likely to cause
death or serious physical
harm to his employees.
At the Home Depot construction project in Roswell, the employee using the
Gradall rough terrain forklift, Model #534D6-42, Serial # 0788009, was not
using
his seatbelt while operating the equipment along the southeast corner of
the
facility to place material on the roof although the forklift was equipped
with a
seatbelt and site rules required its use when operating.  One feasible and
acceptable abatement method includes but is not limited to the statement
below.
Not using a seatbelt while operating a forklift is contrary to ANSI B56.1d
- 1992
5.3.19, which states: An active operator protection device or system, when
provided, shall be used.  Operator protection in the event of tipover is
intended
to reduce the risk of entrapment of the head and torso between the truck
and the
ground but may not protect the operator against all possible injury (see
paragraph
7.2.2). However, steps indicated in paragraphs 5.3.18(d)-(e) should still
be
adhered to.
