Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burn injuries from a potential dust explosion and fire hazard that could have resulted from, or could have been exacerbated by the dust collectors located inside the building. a.) Chopper Area: There were three dust collectors located at Chopper #1, #2 and #3 which were located inside the building, on or about August 18, 2003. ABATEMENT NOTE AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO RELOCATE THE DUST COLLECTION SYSTEMS OUTSIDE THE BUILDING. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
