Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  the
employer did not
furnish employment and a place of employment which are free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that an
explosion hazard exists due to the presence of fine wood dusts in the wood
fuel supply
system:
a)  The inspection port on the wood chip conveyer within the boiler house
was not
equal in strength to the metal panels of the conveyer, as required by NFPA
654:3.7.1, on or about September 12, 2003.
b)  The wood chip conveyer leading to the boiler house was not equipped
with a
device to prevent the spread of a dust explosion, as required by NFPA
654:3.1.3.1,
on or about September 12, 2003.
c)  Deflagration venting was not provided on the wood chip conveyer
leading to the
boiler house, as required by NFPA 664: 3-1.2, on or about September 12,
2003.
ABATEMENT CERTIFICATION REQUIRED
ABATEMENT NOTE:  One feasible method of abatement would be to modify the
equipment to comply with the requirements of NFPA 654 AND 664.
