Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which are free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to an explosion hazard because the air material
separator, which did
not have deflagration vents, and dust bags of the dust collection system
were located inside
of the building.
a.)MI Home Products, Inc. - The ductwork for the conveyor, which was inside
the building, did not have chokes or other devices to prevent the spread
of an explosion in
the ducts.
Abatement Note: One feasible and useful abatement method is to locate
air-material
serparators outside of the building in accordance aith NFPA 654, Section
3.13 Air-Material
Separators (Air-Separation Devices), or meet the exceptions of that
section. (Exception No. 2
states: Those air-material separators that are located within 20 ft. (6 m)
of an exterior wall
and are equipped with deflagration vents that are vented through ducts to
the outside and
where the reduced venting efficiency due to the duct has been accounted
for. The ducts shall
be designed to withstand the effects of the deflagration. Exception No. 3
states: The
requirements of this section shall be permitted to be omitted if the
volume of the air-material
serparator is less than 8 cu. ft. (0.2 m 3)).
