Title 40.1 - 51.1.(a) Code of Virginia:  The employer did not furnish
employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in
that an employee was exposed to a potential fall hazard  of approximately
12 feet while working from the shovel of a
Caterpillar 330B Excavator (Track Hoe) on 7/13/02.
One feasible and acceptable method to correct the hazard is to ensure no
employees ride or work from the shovel of
hydraulic excavators as required in the EMI Safety Manual for Hydraulic
Excavators.
