Title 40.1-51.1(a) Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a) The Greatscapes & More, Inc., electric power hoist, used to move materials from the mezzanine to the floor, which, if dropped, could cause broken bones and/or crush injuries, did not have the rated load visibly marked in pounds on the hoist or load block. "One feasible and acceptable abatement method, among others, to correct this hazard is to visibly mark the rated load on the hoist or load block as identified in ASME/ANSI B30.16b section 16-1.1." (b) The Greatscapes & More, Inc., electric power hoist, used to move materials from the mezzanine to the floor , which, if dropped, could cause broken bones and/or crush injuries, did not have affixed to the hoist or load block, a label concerning operating procedures such as such as, but not limited to, a "WARNING" label containing cautionary language against (a) lifting more than the rated load; (b) operating the hoist when the load is not centered under the hoist; (c) operating the hoist with twisted, kinked, or damaged chain or rope; (d) operating damaged or malfunctioning hoist; (e) lifting people or loads over people; (f) operating a rope hoist with a rope that is not properly seated in its groove; (g) removing or obscuring warning label. "One feasible and acceptable abatement method, among others, to correct this hazard is to affix a label or labels displaying information concerning operating procedures as identified above as referenced in ASME/ANSI B30.16b section 16-1.1.4(b)(2)." (c) The Greatscapes & More, Inc., electric power hoist, used to move materials from the mezzanine to the floor, which, if dropped, could cause broken bones and /or crush injuries, was not installed such that the supporting structure has a load rating at least equal to that of the hoist. "One feasible and acceptable abatement method, among others, to correct this hazard is inspect the hand operated chain hoist in accordance with the procedures identified in ASME/ANSI B30.16b section 16-1.3.1" (d) The Greatscapes & More, Inc., electric power hoist, used to move materials from the mezzanine to the floor, which, if dropped, could cause broken bones and/or crush injuries, was not subject to frequent and periodic inspections. "One feasible and acceptable abatement method, among others, to correct this hazard is inspect the hand operated chain hoist in accordance with the procedures identified in ASME/ANSI B30.16b section 16-2.1."
