40.1-51.1(a) of the Code of Virginia:  The employer, Perry Judds Inc., did
not furnish each   employee safe
employment and a place of employment which was free from recognized
hazards that were causing or were likely to
cause death or serious physical harm to employees, in that employees were
operating a  Jet 1880 Lathe (which
exposes them to serious injury or potential death from rotating parts)
without being adequately trained in the safe
method of performing any operation on the type of lathe they will set up
or operate.
This hazard and requirement for training is recognized throughout the
industry; and by American National Standards
Institute [ANSI] B.16-1984, American National Standards Safety Code for
machine tools & lathes, Section 7.1.1
Instruction of Employees,  ...  The employer shall train and instruct the
set up personnel, set up operator, operator,
and helpers in the safe method of performing any operation on the type of
lathe the employee will be required to
operate or set up.
On May 3, 2002, an accident occurred involving an employee, who set up the
Jet
1880 Lathe, without supporting the
live end with the tail stock. The twenty-six  and one-half inch shaft was
turning at 1800 rpms, with a bearing stuck on
the live end.  As the operator began polishing the shaft with a flat file,
the  shaft bent, striking operators left arm, and
chest.
One feasible and acceptable abatement method, among others, to correct
this hazard is to instruct and train the setup
operators in the safe method of performing  any operation on the type of
lathe the employee will be required to set up,
or operate.
