40.1-51.1(a) of the Code of Virginia:   The employer, Technicolor, did not
furnish each of their employees a safe
employment and a place of employment which was free from recognized
hazards that are causing or likely to cause
death or serious physical harm to employees, in that employees operate a
stationary trash compactor which exposes
them to potential fractures, laceration or limited disability when its
control switches malfunction.
a.  The trash compactor in the disc grinding room did not function, in
accordance with the forward and reverse controls
indicated on each button. American National Standards Institute (ANSI)
Z245.1 1984, (6.4 & 6.5) requires
establishing  and following a program of periodic & regular inspections to
ensure that all parts, components, and safe
guards  are in safe operating condition, and adjusted in accordance with
the manufacturer's recommended procedures.
This should include keeping all malfunction reports, records of
inspections, and  maintenance work performed.
b.  The trash compactor in the disc grinding room had no sign posted
inside or outside saying-  Caution - KEEP
OUT, or  Danger - DO  NOT  ENTER.    ANSI  Z245.1 1984, (8.9.2)  requires
a sign to be posted inside,  saying:
DANGER - "DO  NOT  ENTER,"  and a sign on the outside face of the charging
hopper, saying: CAUTION - KEEP
OUT
One feasible and acceptable abatement method, among others, to correct
this hazard is to inspect and test the
mechanical components and safeguards to determine their safety and
compliance with the requirements of this code
before being placed in service.
