Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that: employees were
exposed to a fall hazard.
(a)On or about April 12, 2002, carpenters (2) were elevated in a
personnel lifting platform (made by Ollman Construction) while
the operator was driving down the road.  The personnel lifting
platform was approximately 6-8 feet above the ground and had no
guardrail on the front.  The carpenters did have personnel fall
arrest system on and in use but the carpenters were still exposed
to a hazard of getting thrown from the platform.
A feasible mean and method of correction among others could
have been achieved by following the Sky Trak Rough Terrain
Forklift owner/operator manual (onsite at the time of the
inspection) and observing the posted warning decals on the forklift.
The employer could have also abated by following the ANSI
B56.6-1992 Safety Standard for Rough Terrain Forklift Trucks,
Part 5.15 Elevating Personnel.
No certification required.  Violation Abated.on
