Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(1)On April 29, 2002, at 750 Fox Lane, Waterford, Wisconsin, an
employee working from the JLG Model 600S, serial number
030039291, boom-supported elevating work platform was exposed
to the hazard of falling from the eave height of 29'6", and/or
being thrown out of the basket, while being transported from the
roof to the ground.
Among other methods, one feasible and acceptable method to
correct the hazard is to provide the employee with a fall protection
device that complies with American National Standards Institute
A92.5-1992, Section 8.8, which requires all personnel in the
platform to wear fall protection devices and other safety gear as
required at all times.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
