Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
(a)Employees were exposed to an amputation hazard because the foot
pedal and/or treadle on the Verson 308 90 ton mechanical press
brake, serial #14286, the Cincinnati 90T mechanical press brake,
serial #unknown, the Cincinnati 5 135 ton mechanical press brake,
serial #35434, and the Diacro 35 ton hydraulic over mechanical
press brake, serial #unknown, were not protected so as to inhibit
accidental actuation.
One feasible and acceptable abatement method, among others, to
correct this hazard is to provide protection as described in ANSI
Standard B11.3 - 1982, Section 4.3.4.3 that states "A foot control,
if used, shall be protected so as to inhibit accidental actuation by
falling or moving objects, or by someone stepping on it."
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
