Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
a)On or about May 30, 2002 and June 5, 2002, the unguarded lowest part
(underside) of conveyor C3 was located at 65" from the floor, exposing
employees to inadvertent contact with the moving conveyor belt and to a
struck by hazard because of the lack of headroom.
b)On or about May 30, 2002 and June 5, 2002, two tire conveyors had no
spill, pan, barrier, or equivalent guards to prevent tires from falling off
the inclined belt conveyors and striking employees working in the area,
exposing employees sorting tires or working at the shredder control panels
to a struck-by hazard.
Among other methods, one feasible and acceptable abatement method to
correct
these hazards is to provide sufficient headroom and guards such as is
identified
in requirements of ASME B20.1-1993, Safety Standard for Conveyors and
Related Equipment.
Certification, with date and method of abatement required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
(a)On or about May 30, 2002 and June 5, 2002, the employer did not
require the use of the operator restraint device on the Clark
forklift, serial number unknown, which exposed employees to the
hazard of being crushed by the forklift should it overturn.  The
hazard of entrapment of the operator's head or torso between the
forklift and ground is recognized by the current consensus
standard, ASME/ANSI B56.1a-1989 addendum to ASME/ANSI
B56.1-1988, and ASME B56.1-1993, Safety Standard for Low Lift
and High Lift Trucks.  Tipover of this forklift would expose the
employee to being crushed by the forklift and the yard bucket
attachment with steel wire or shredded rubber loads.
One feasible and useful method to correct this hazard is to enforce the
use of the
operator restraint/seat belt with which the forklift is equipped.
