Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by and other serious hazards from operation of
self-propelled integral-
chassis aerial platforms being operated by persons who failed to maintain
a safe distance from
stationary objects.
On June 20, 2002, an employee of Milwaukee World Festivals was driving an
aerial lift through the grounds and struck a scissors lift in which an
employee of
another employer was working, causing serious injuries to that employee.
A feasible method to abate this hazard, among others, is to train all
employees
who are to operate this type of equipment as part of their job
description, in the
safe and proper operation of the equipment per the equipment manufacturer's
operating instructions as required by ANSI A92.5, BOOM-SUPPORTED
ELEVATING WORK PLATFORMS, paragraphs 7.6 and 7.7.  The training must
include as a minimum:
1)Instruction by a qualified person in the intended purpose and
function of each control,
2)Review of and demonstrated understanding of the manufacturer's
operating instruction(s) and users safety rules, or been trained by
a qualified person on the contents of the manufacturer's operating
instruction(s) and users safety rules,and,
3)An explanation of all decals, warnings, and instructions displayed
on the aerial platform.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment

were exposed to the struck-by and other serious hazards created by
malfunctioning self-propelled
integral chassis aerial platforms due to lack of equipment inspections:
a)Before use each day or at the beginning of each shift, the employer
did not ensure that the self-propelled integral chassis aerial
platforms were given a visual inspection and functional test, as
required by the manufacturer's operator's manual, that included,
but was not limited to the following:
1)Operating and emergency controls.
2)Safety devices.
3)Personal protective devices, including fall protection.
4)Air, hydraulic, and fuel system leaks.
5)Cables and wiring harness.
6)Loose or missing parts.
7)Tires and wheels.
8)Placards, warnings, control markings, and operating and safety
manual(s).
9)Outriggers, stabilizers, extendible axles and other structures.
10)Guardrail system.
11)Items specified by the manufacturer.
One feasible abatement method is to institute an inspection system as
indicated in,
and required by, the operator's manual for this equipment.
