Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by falling material:
(a)While working below a billboard structure located at 800 West Mt.
Vernon Avenue, Milwaukee, Wisconsin, employees were exposed to the
hazard of being struck by material that was being thrown from a billboard
work platform approximately 120 feet above grade.
Feasible abatement methods include, but are not limited to:
1.Follow the guidelines set forth in the 1994 edition of the Outdoor
Advertising Association
of America Safety Manual, Appendix A, Apprenticeship Program for Climbers
and
Introduction for General Billposting Procedures, when descending a panel
and removing
equipment from a structure.
2.Follow the guidelines for safe work procedures outlined in OSHA
Directive STD 1-1.14,
Appendix A, Gannett Outdoor Apprenticeship Program for Climbers and
Introduction for
General Billposting Procedures, when descending a panel and lowering
equipment and
materials from structures.
3.Follow the "Handling Materials" section of the Clear Channel Outdoor
Personal Conduct
and Safety Manual.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.

(a)On July 8, 2002, Respondent failed to detect that its employees were not
using their LAD-SAF ladder climbing safety devices while working at a
billboard structure located at 800 West Mt. Vernon Avenue, Milwaukee,
Wisconsin.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten
(10) calendar days after the abatement date.
