Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee was exposed to the hazard of falling from an elevation of 19 feet while working from a wooden job-made work platform that: (a) was not secured to the lifting carriage forks of the SkyTrak Rough Terrain Forklift; (b) the employee was working from the elevated platform without fall protection; and (c) the controls of the rough terrain forklift were left unattended. Among feasible means of abatement, one method would be for the Employer to follow the work practices identified in the American Society of Mechanical Engineers ASME/ANSI B56.6-1992 Safety Standard for Rough Terrain Forklifts. No certification required. Violation Abated.on
