Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard of approximately 50 feet to the sidewalk and
a thrown-from
hazard.
(a)On or about July 16, 2002, at the job site located at the Wayman
AME Church, 424 N. Memorial Drive, Racine, WI, a worker who
was painting the trim around windows on the east wall was
elevated in a Nifty-Lift articulating boom platform (self-propelled),
and was exposed to injuries from falls due to the lack of personal
fall protection devices.  This exposed employees to a fall of
approximately 50 feet.
A feasible means of abatement among others, would be to comply
with the American National Standard Institute (ANSI) A2.5-1992
Standard for Boom-Supported Elevating Work Platforms which
requires workers to wear personal fall arrest equipment whenever
in an aerial lift.
Certification and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten
(10) calendar days after the abatement date.ment
