Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall/thrown-from hazard of 7 feet:
(a)On or about July 30, 2002, at the jobsite located at 161 W.
Wisconsin Avenue, Pewaukee, WI, employees were elevated in 2
Star Industries personnel platforms, Numbers 3 and 5, by 2
Pettibone Rough Terrain Forklifts, Numbers 4 and 8 and:  (a) A
trained operator was not in position to control the rough terrain
forklift truck or available to operate controls.  The operator was
inside the building working; (b) The truck wheels were not
blocked while the operator was not in the operator's position; (c)
The platforms were not lowered to floor level for personnel to
enter and exit. An employee exited one basket while it was
elevated and climbed up into the other platform while it also was
elevated; (d) Information was not prominently indicated on the
platforms indicating the maximum work load including personnel
and equipment and the weight of the empty platforms.
A feasible means of abatement, among others, would be to comply
with the American Society of Mechanical Engineers / American
National Standards Institute, Safety Standard for Rough Terrain
Forklift Trucks, ASME/ANSI B56.6b-1998.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
