Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to serious injuries from falls. While working from a Boom-Supported Elevating Work Platform, installing sheetmetal on the north elevation of the jobsite at Boerner Botanical Gardens, located at 5879 S. 92nd Street, Hales Corners, WI, an employee's personal fall protection system lanyard was not tied to an anchorage point which exposed the employee to a fall or thrown from hazard of 16 feet to grade. Among others, one feasible and acceptable method of abatement would be to follow the American National Standards Institute/Scaffold Industry Association, ANSI/SIA A92.5-1992, Boom Supported Elevating Work Platforms, Section 8.8 (g) "Ensure all personnel in the platform are wearing fall protection devices and other safety gear at all times." No certification required. Violation Abated.on
