Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of approximately 14 feet to the sidewalk and a thrown-from hazard. (a)On or about October 1, 2002, at a jobsite located at 3118 N. 27th Street, Milwaukee, WI, a worker who was painting around windows on the west wall, was elevated in a JLG Lift 400S (self- propelled articulating-boom platform), and was exposed to injuries from falls due to the lack of personal fall protection devices. This activity exposed employees to a fall of approximately 14 feet. A feasible means of abatement, among others, would be to comply with the American National Standard Institute (ANSI) A92.5-1992 Standard for Boom-Supported Elevating Work Platforms which requires workers to wear personal fall arrest equipment whenever in an aerial lift. No certification required. Abated during the inspection.on
