Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized
hazards that
were causing or likely to cause death or serious physical harm to
employees in that the
employees were exposed to a 15 foot fall/thrown-from hazard:
(a)On or about November 13, 2002, on the south elevation of the
Kenosha Trade & Commerce Park building under construction at
4019 43rd Street, Kenosha, WI, the employer did not ensure that
employee(s), while elevated in the Genie S-40, Boom-Supported
Elevating Work Platform, for the purpose of accessing their work
area on the roof and also for facia installation were not protected
from a fall/thrown-from hazard while elevated.
Among others, a feasible means of abatement would have been to
follow the Genie lift manufacturers posted fall hazard safety
requirements and the ANSI/SAI A92.5-1992 Section 8.8(g) "
Ensure all personnel in the platform are wearing fall protection
devices and other safety gear at all times."
No certification required.  Violation Abated.on
