Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of underhung crane failure: a)The employer did not perform frequent inspections on the underhung crane(s) used in the facility. This exposed the employees to the hazards created by the failure of one or more of the crane(s) components due to the lack of effective preventative maintenance. Among others, a feasible and acceptable method to abate this hazard is to incorporate a frequent crane inspection program to be conducted on a monthly basis. This could be accomplished by either providing appropriate training to one or more of the company's employees and having those employees conduct the inspections, or contract with a crane servicing company to conduct the inspections. Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.
