Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)At the worksite at 413 North 2nd Street, Milwaukee, WI, 53203, the
foreman
was riding down to the ground level from the 6th floor in the work platform
(basket) of the Aerial Work Platforms, model S-85 Genie Boom, articulating
boom platform (self-propelled) and had no personal fall arrest system.
Among
feasible abatement would be to comply with the American National Standards
Institute (ANSI) A92.5 - 1992 Standard for Boom-Supported Elevating
Platforms
and have employees wear fall arrest equipment whenever they are in an
aerial lift.
Without such protective equipment the worker was exposed to the hazard of
falling to the concrete about 65 feet below.
Certification, with date and method of abatement required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
