Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On or about June 25th, 2003, at the job site located at 5380 N. Port Washington Road, employees were exposed to a fall hazard in excess of 25 feet while climbing over the top rail of a Grove Manufacturing Company scissors lift. A feasible means of abatement would be to comply with American National Standards Institute (ANSI) A92.6-1999 Self-Propelled Elevating Work Platforms which requires workers to maintain firm footing on the platform floor while working thereon and states that climbing by occupants on the midrail or toprail of the aerial platform is prohibited. No certification required. Violation Abated.on
